How Is an Appeal Different From a Trial?

An appeal differs from a trial in that an appeal is limited to an examination of the proceedings in the lower courts. The purpose of the appeal is not to retry the case, but to determine if the lower court made a mistake or your trial was fraught with error. An appellate attorney will not usually have the opportunity to raise issues or arguments not raised before the trial court. Instead, the appeals process is based on the testimony, documents and rulings of the lower court proceeding.

  • A finding by a judge or jury that is not supported by evidence
